Introduction

Allow us to inform you, AI-TOMATICA s.r.o., with registered office at Nová 888/10, Dolní Chabry, 184 00 Prague 8, Company ID: 213 03 223, registered in the Commercial Register maintained by the Municipal Court in Prague under file no. C 399825, as the controller of your personal data (hereinafter referred to as "AI-TOMATICA" or "we"), about the processing of your personal data, in accordance with Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data, and Act No. 110/2019 Coll., on Personal Data Processing.

AI-TOMATICA s.r.o. must also collect, store, use, and otherwise process your personal data in connection with offering its services. Through this information, you can learn what personal data about you AI-TOMATICA as the controller processes, for what purposes your personal data is processed, and what rights you as data subjects have in connection with the processing of your personal data.

This information on personal data processing and protection applies to:

• personal data processing by AI-TOMATICA during your use of the website https://ai-tomatica.cz (hereinafter referred to as the "Website");
• personal data processing performed by AI-TOMATICA during email or telephone communication with you and when handling your requests;
• personal data processing performed by AI-TOMATICA during the negotiation of specific service offers from AI-TOMATICA and subsequently during the provision of these services, i.e., during the performance of a specific contract;
• if you are our client or subscribe to newsletters and have not opted out, we process personal data for the purpose of sending commercial communications and service offers;
• personal data processing during the fulfillment of AI-TOMATICA's legal obligations and on personal data processing that is necessary for the purposes of protecting AI-TOMATICA's legitimate interests.

What personal data do we process

We only process personal data that you provide to us during our communication or when negotiating the terms of a specific contract and its performance. We process especially the following personal data:

• first and last name,
• date of birth or birth number,
• permanent and temporary residence,
• billing and delivery address,
• identification number (Company ID) and tax identification number (VAT ID),
• banking details,
• phone number and email address.

For what purpose and for what reason we process your personal data

We must store your personal data both for reasons stipulated by law and the above regulation and for purely practical reasons. In the following list, you can check how your personal data will be handled in a specific way:

• First of all, we must process your personal data for the purposes of our communication not only through the form on our Website, negotiating the terms of the relevant contract between us and subsequently fulfilling our obligations based on that contract.
• We further process your personal data for the purposes of our mutual financial settlement, especially payments for performance under the relevant contract between us.
• We process your personal data because it is necessary to fulfill the legal obligations we have, especially during inspections by public administration authorities or when fulfilling other obligations, e.g., when fulfilling the obligation to provide this data to authorities active in criminal proceedings, etc.

In all cases, we process your personal data only if it is necessary, and only to the extent that is absolutely necessary.

Providing personal data to third parties

In such cases, we provide your personal data to third parties only to the extent absolutely necessary.

Your data is accessible to AI-TOMATICA employees and contractual partners, especially if they need it to fulfill legal obligations. The term "contractual partners" refers to providers who, based on business agreements with AI-TOMATICA, participate in providing marketing and related services.

We can share information about you with third parties only when it is necessary to comply with legal regulations, obligations arising from the contract between us, or with regard to our legitimate interest, unless this interest is not in accordance with your interest or your fundamental rights and freedoms. The mentioned third parties include:

• public authorities (tax and labor),
• travel and transport agencies and other legal entities for the purpose of ensuring trips and stays related to our cooperation,
• embassies and consular offices of states,
• state security forces, state agencies or offices, as well as courts in the event of security-related events.

Method and duration of personal data processing

We process your personal data primarily manually, but also automatically, and they are stored in paper and electronic form. When processing your personal data, we take all necessary technical and organizational measures to ensure their protection.

When fulfilling our obligations or when fulfilling your rights arising from the contract between us, we will process your personal data for the entire duration of such contract or service provision and further for a maximum of three years from the date of termination of this contractual relationship, unless in a particular case there arises a need to store such data longer. Personal data that is necessary for the fulfillment of our legal obligations under applicable legal regulations, we store for the entire period necessary to fulfill these obligations.

For the purpose of protecting the legitimate interest of AI-TOMATICA or third parties, we will process your personal data for a maximum of 3 years from the beginning of data processing, unless special legal regulations provide otherwise, or unless in a justified case there arises a need to store data for a longer period in connection with a specific case.

We store personal data for the period determined according to the purpose of their processing. The personal data retention period is listed below.

Your rights in connection with personal data processing

In connection with the processing of personal data, you have a number of rights. You can ask us at any time by mail or email to confirm whether your personal data is being processed, and if it is, you have the right to access this personal data and information about it. You have the right to correct inaccurate or supplement incomplete personal data.

You can ask us at any time to delete this personal data if there is a reason for it, or, also if there is a reason for it, to restrict the processing of this personal data. You have the right to transfer your data to another controller. You can also object to the processing of personal data that is processed for the purposes of performing a task carried out in the public interest or in the exercise of official authority or for the purposes of protecting the legitimate interests of AI-TOMATICA. In the event that AI-TOMATICA does not prove the existence of a serious legitimate reason for their processing that outweighs your interest or rights and freedoms, processing will be terminated without undue delay based on the objection.

We process personal data fairly and transparently. However, if you believe that this is not the case, you always have the right to file a complaint with the Office for Personal Data Protection. All information, as well as contact, can be found on the website: https://www.uoou.cz/.

Additional information

We received your personal data only from you. The legal basis for the processing of personal data is your communication with AI-TOMATICA or a contract concluded between us, even if this contract does not have to be in writing.

If you did not provide us with the required personal data, or requested their deletion, it would not be possible for AI-TOMATICA to continue communicating with you, or we would not be able to offer and continue providing our services to you.

After the processing period ends, personal data is then disposed of without delay.
